Terms of Service

These Terms of Service ("Terms") govern your use of the US Video API service ("Service") operated from Houston, Texas. By creating an account or making API calls, you agree to these Terms.

1. Service Description

US Video API provides programmatic access to AI video generation capabilities via a REST API. We act as an intermediary between you and upstream model providers to deliver video generation services with US-based support and billing.

2. Account & API Keys

• You must provide a valid email address to create an account
• You are responsible for keeping your API keys confidential
• You are liable for all usage under your API keys, whether authorized by you or not
• Notify us immediately at [email protected] if you suspect unauthorized use
• One account per person or entity; we may terminate duplicate accounts

3. Pricing & Billing

• Pricing is usage-based and charged per second of generated video
• Current rates are displayed at /v1/pricing and on our website
• Prepaid balance is required before generating video
• Prepaid balance is non-refundable except for failed generations (auto-refunded)
• We reserve the right to adjust pricing with 30 days notice via email
• Payment processing is handled by Stripe. You agree to Stripe's terms when adding a payment method

4. Acceptable Use

You agree not to use the Service to generate:

• Child sexual abuse material (CSAM) or content sexualizing minors
• Non-consensual intimate imagery of real people
• Deepfakes intended to deceive, defraud, or defame
• Content that incites violence, terrorism, or hatred against protected groups
• Content that violates applicable law in your jurisdiction

We monitor for policy violations and may immediately suspend accounts without notice for serious violations. Suspended accounts forfeit remaining balance.

5. Content Ownership & License

• You own the videos you generate through the Service, subject to upstream model licenses
• You grant us a limited license to process and temporarily store your prompts and generated content solely to provide the Service
• Generated videos are stored for up to 72 hours, then automatically deleted
• We do not use your prompts or generated content to train models or for any purpose beyond fulfilling your requests

6. Upstream Dependencies

The Service relies on third-party AI model providers (currently BytePlus/ByteDance Seedance 2.0). We do not control upstream availability, capabilities, or content policies. If the upstream provider:

• Rejects a prompt for content policy reasons, no charge is applied
• Experiences downtime, your jobs will queue and process when service resumes
• Changes capabilities or pricing, we will communicate impacts to you

7. Service Level

We target 99.9% API gateway uptime (excluding upstream provider outages). This is a target, not a guarantee. We do not offer SLA credits at this time. For enterprise SLAs, contact [email protected].

8. Rate Limits

We enforce rate limits to ensure fair access. Limits vary by account tier and are documented in our API documentation. Exceeding rate limits returns HTTP 429. Persistent or intentional abuse of rate limits may result in account suspension.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your generated content, or your violation of these Terms.

12. Termination

• You may close your account at any time by emailing us
• We may suspend or terminate accounts for Terms violations
• Upon termination, your data is deleted per our Privacy Policy
• Remaining prepaid balance is forfeited upon termination for cause

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas.

14. Changes to Terms

We may update these Terms with 30 days notice via email. Continued use after the effective date constitutes acceptance. If you disagree, close your account before the changes take effect.
